刍议我国孤儿作品的保护及其利用——兼谈《著作权法》(修改草案第三稿)第26条

On Protection and of Utilization of Orphan Works in China ——Discussion on Twenty-Sixth Provision of Copyrights Law(Third Remedy Draft)

我国现行的法律上没有对孤儿作品的明确规定,但与其相关内容却是有所提及。由于现实生活中孤儿作品的大量存在,而理论上对此尚未形成定论,司法实践中缺乏明确的法律指导,以致于孤儿作品面临着诉讼纠纷和资源浪费的困境。本文试图通过厘清孤儿作品的概念,分析现行法律的规定,进而探求合理的利用方式和法律保护模式。

There is currently no definite definition of orphan works in the Chinese legal system, with the exception of a few related provisions. Owing to the absence of such practical legal guidance, a large number of orphans' works are usually apt to get in litigation disputes or be ignored. This paper endeavors to seek for reasonable approaches to exploring and protecting these, after it makes an analysis of relevant legal regulations.
