On the Establishment of Information Disclosure Mechanism in Accordance with International Rules: Combing the Example of China( Shanghai) Pilot Free Trade Zone

信息流通理论是一种通过动态和宏观角度关注一国信息环境内各种信息流间相互作用基础上设计信息公开制度并提升其实施成效的理论。符合国际规则的信息公开机制的构建离不开对信息流间相互关系的关注。这意味着我们需依托社会力量,侧重从主动公开、被动公开和外部公开相互关系角度,实现内部公开和外部公开的联动。这就需要做到及时主动公开充分的具有公共性质的信息以及非必经第三方意见征询部分公开相对式例外信息。只有这样,才能起到积极鼓励社会力量参与市场监督的效果。中国(上海)自由贸易试验区总体方案及其他配套制度都体现了这点。

Information flow, which is a theory to design information disclosure system and improve the effectiveness of its im- plementation on the basis of the interaction between various information flows in an information environment based on the concern of dynamic and macro perspective. The construction of the information disclosure mechanism in accordance with international rules can- not do without the concern of the interrelationship between information flows. It means that the achievement of the interaction between internal and external disclosure needs to rely on social forces and emphasize on the perspective of active disclosure, passive disclo- sure and external disclosure. It requires disclosing the public information timely and actively and consulting part of the public relative exemption information without suggestions of the third party. Only in this way, it can actively encourage social forces to participate in the market supervision. The general plan of China （Shanghai） Pilot Free Trade Zone and its relevant rules can embody the above points.
