法律视域下西夏畜牧业管理机构及相关问题探析

Analysis of the Management of Animal Husbandry and Related Issues in Hsi-Hsia from the Perspective of Law

畜牧业是西夏的重要经济产业之一,西夏对畜牧业极为重视。文章在西夏法典《天盛律令》的基础上,通过法律视角对西夏的畜牧业管理机构问题进行探析。提出西夏的牧业机构分为专门性和兼职性两种,并探讨其各自的职权范围,进而分析了西夏牧业职司的官员体制和"实名负责制"下基层牧养人员的情况以及在此基础上西夏制定实施一套完整的牧业管理体制。在法律保护下西夏畜牧业长足发展,并对经济、军事、民族性等方面有一定的影响。

The animal husbandry is one of the important economic industries in Hsi-Hsia.Hsi-Hsia attaches great importance to the animal husbandry .Based on the foundation of Tian Sheng Laws and from the perspective of law, this paper analyses the management of animal husbandry and related issues .It claims that Hsi-Hsia has adopt-ed specialized and amateur mode of management and the functions and powers of them are quiet different .It also explores the officials system and its shepherds ’ situation under the “real-name system” and concludes that Hsi-Hsia has formulated a comprehensive set of animal husbandry management system .Hsi-Hsia ’ s Animal husbandry has developed significantly under legal protection .It exerts an important influence on economics , military and Na-tional character .
