基层人民法院民事司法调解的困境及对策——以镇原县人民法院为例

The Bewilderment and Countermeasure of Civil Mediation in Grass-roots Courts——A Case Study of Zhenyuan Court

以调解方式解决民事纠纷具有重要作用,其中,司法调解功能的加强尤为关键。当前,在基层法院,进一步深刻认识司法调解在解决社会矛盾冲突中的地位并尽快加强司法调解功能的实效很有必要。通过对镇原县人民法院民事司法调解实务的调查可以看出,目前基层法院民事调解实务中存在制度和操作诸方面的问题,而造成这些问题的原因有宏观和微观方面的,也有客观和主观方面的。为此,在完善相关法律制度及配套措施之余,还应处理好四个方面的关系,即调解与审判的关系、法院调解与诉讼外调解的关系、调解与调解结案的关系、司法传统与司法现实的关系。

It is of considerable significance to solve civil by mediation and strengthen the function of judicial mediation.It is of prominent practical usefulness to realize the position of judicial mediation deeply and strengthen the actual effect of it in dealing with the social conflicts at present .There are systematic and operational problems in judicial mediation through the survey of civil cases in Zhenyuan Court .The reason is macroscopical and microcos-mic as well as subjective and objective .Thus, on the one hand, the problem can be solved by improving the rele-vant legal system and supporting measures .On the other hand , we must recognize and dispose four relationships correctly.The relationships are between mediation and judgment , court mediation and non-proceeding mediation , mediation and ending a case by mediation , judicial tradition and judicial reality .
