The Contract Connotation of Modern Government from the Classical Social Contract Theory

政府权力来源问题一直是支撑其合法性的基础,也是支撑政府公信力的基石,对政府来源的不同阐释意味着这个行为体存在和执行权力的方式与范围就不同。通过梳理古典社会契约思想,用契约的内涵塑造政府的合法性和主体地位,可以更好的规范现代政府的行为。

The source of the government＇ s power has always been the basis of its legitimacy as well as its public credibility. Dif- ferent interpretations of the source of governments＇ power imply different manners and scope of this unitary actor＇ s existence and exec- utive power. By combing the classical social contract theory and shaping the legitimacy and the main body status of the government with the contract content, the modern government can regulate its activities in a better fashion.
