摘要
本文结合医疗纠纷案件审判实践,分析了医疗纠纷发生的原因,提出了医疗机构在处理医疗纠纷时应当注意的七个方面的问题以及预防医疗纠纷应做好的七项工作,分别是:强化首问责任制、防止患方陷阱取证、不轻易修改病历、积极配合患方复印封存病历和做医疗鉴定、必要时主动申请鉴定、积极面对媒体采访、对医闹决不姑息迁就;加强业务学习、严格遵守相关法律法规和医疗常规、健全医疗服务质量管理体系、向患者说明病情和医疗措施、加强医患沟通、高度重视病历的书写、防止出现与医疗机构或医疗工作有关的其他纠纷。
In combination with the trial practice of medical disputes, this article analyzes the reasons for the occurrence of medical disputes, puts forward seven problems in processing medical disputes for medical institutions which should be paid attention to ( they are: strengthening the asking system of job responsibility; preventing the risk of trap forensics; not modifying the medical records easily; actively cooperating with patients in copying sealed records and doing medical appraisal; asking for identification when necessary; facing the media positively; never tolerating with medical disturbance) and the seven works in preventing medical disputes which should be done well ( they are: strengthening the professional study; strictly abiding by the relevant laws and regulations and medical routine; improving medical service quality management system; explaining the conditions and health measures to patients; promoting the doctor-patient communication; attaching great importance to the writing of medical records; preventing other disputes related to the medical work and medical institutions).
