摘要
由于近年来专利海盗对美国经济以及企业的技术研发和生产经营所产生的影响正在扩大,学术界的分析和研究、行政主管部门的调查和国会立法都在展开。美国政府也发布了关于专利海盗的研究报告并公布了一系列行政措施和立法建议,提出了包括惩罚滥用诉讼、披露权利人信息、提高审查标准以及改进行政执法等多项措施以遏制专利海盗。借鉴美国针对专利海盗的各类最新调查与规范,我国也应当通过提高专利质量、限制恶意诉讼以及加强反垄断执法等措施防范和限制专利海盗。
In recent years, the influence of patent trolls on American economy and enter- prise＇s technology research and management is expanding. A series of academic analysis, ad- ministrative investigations and Congress legislation are launched. The White House issued several executive actions and legislative proposals and released a report about patent trolls. It is proposed that punishing the abuse of litigation, disclosing information of patent holder, enhancing the re- view standard, improving the administrative enforcement and other measures to limit patent trolls. By introducing and analyzing various surveys and specification on patent trolls in America, we al- so should limit and regulate this problem in China. It is suggested that enhancing the standard of patent, improving anti - monopoly enforcement, limiting malicious litigation and other measures.
