集体经营性建设用地流转制度建设研究——基于优化资源配置方式的视角

On Institutional Construction of the Transference of Profitable Collective Constructive Land

推进集体经营性建设用地入市流转是保护农民权益、提高集体建设用地利用效率、减少社会矛盾和纠纷的重要手段。但当前我国集体经营性建设用地存在低效率流转,因此,集体经营性建设用地流转的制度设计框架,主要包括确立市场制度和转变政府职能两个方面,应加强集体经营性建设用地法制建设、推进集体经营性建设用地确权登记、强化集体经营性建设用地规划管理、构建集体经营性建设用地交易平台、健全集体经营性建设用地流转机制、完善农村集体经济组织体制机制等。

The transference of profitable collective constructive land is an important method to protect peasants＇ interest, improve the effect of collective constructive land, and reduce social contradictions and dispute. But there is low efficiency in the transference of profitable collective constructive land. We should have the system design fi＇om establishment market system and transform of government functions, and strengthen legal construction, advance the registration of land, intensify the program management of collective constructive land etc.
