物权确认请求权的性质及其与相关规定的适用问题探讨

物权确认请求权不属于物权请求权,而是规定在《物权法》上的程序性的权利,具有区别于物权请求权的独特属性。由此就决定,物权确认请求权不适用诉讼时效。物权确认之诉与执行异议之诉有明显的区别,不能相互替代,由此彰显了物权确认请求权的独特地位与作用。

The confirmation of property claim does not belong to the right of claim of property, but is a procedural right in Property Law, and has a unique attribute that know from right of claim of property . Therefore, the confirmation of property claim does not apply to the limitation of action. There are obvious difference between the action of confirmation of property and execution objec- tion ,they can not replace each other, which show unique position and role of right of confirmation of property claim.
