我国小额诉讼程序适用的案件类型之规范化探究

小额诉讼程序是我国2012年8月31日第十一届全国人民代表大会常务委员会第二十八次会议通过的《关于修改〈中华人民共和国民事诉讼法〉的决定》(以下简称《新民事诉讼法》)中首次确立的一项诉讼制度。小额诉讼程序的确立,其在方便当事人诉讼、降低诉讼成本、提高审判效率等方面发挥了一定的作用。由于《新民事诉讼法》对小额诉讼程序的适用案件类型规定不够明确、具体,以致于司法实践中各地对适用小额诉讼程序的案件类型规范极不一致,不利于司法的统一。因此,对适用小额诉讼程序的案件类型进行规范具有明显的必要性。我国对小额诉讼程序适用案件类型的规范应采取抽象概括式和消极列举式相结合的规范模式。

Small claims procedure as a litigation system established for the first time in China in August 31,2012 which is through by the eleventh session of the National People＇ s Congress Standing Committee of the twenty - eighth meeting of the ＂on the revi- sion of ＇ of the people＇s Republic of China Civil Procedure Law＇ decision＂ （ hereinafter referred to as ＂the new civil procedure law＂ ） . The establishment of small claims procedure is played a certain role in the facilitate the parties to litigation, reduce the lawsuit cost, and improve the trial efficiency etc. Because the regulations for the case types of the small claims procedure is no clear, specific, resulting in the judicial practice case type specification is applicable to small claims procedure is not unified, not conducive to the judicial unification. Therefore, the application of small claims procedure case type specification has apparent ne- cessity. The case types of small claims procedure should take the model of abstract generalization and negative enumerative com- bined.
