知识产权视角下纳西族传统知识经济价值实现途径探析

Study on the Economic Value of Naxi Traditional Knowledge:From the Perspective of Intellectual Property Right

纳西族传统知识的经济价值日益显现。传统知识是一种"知识财富",并表现为非物质文化遗产,这仅仅只是传统知识经济价值的浅层表现。要实现传统知识的经济价值,需要解决传统知识的"产权化"问题。现行知识产权法律仍然是当前传统知识保护最有效的手段。发展传统知识版权经济、专利经济、品牌经济,是传统知识经济价值实现的根本途径,也是传统知识经济价值的深层表现。针对传统知识经济价值实现过程中存在的问题,提出提升传统知识经济价值的对策建议。

The economic value of Naxi traditional knowledge is increasingly obvious. Traditional knowledge is a kind of “knowledge wealth” and manifests as intangible cultural heritage. This is just a simple form of the economic value of traditional knowledge. In order to implement the economic value of traditional knowledge, we need to solve the problem of “obtaining property rights” of it. The author believes that the current intellectual property laws are still the best ways to protect traditional knowledge as intellectual property rights. This paper empirically studies the development of traditional knowledge in copyright, patent and brand economy and finds out that it is the basic way for traditional knowledge to realize its economic value. And that is also the deep form of the economic value of traditional knowledge. This paper points out the existing problems in implementing the economic value of traditional knowledge and trots forward some countermeasures.
