论我国检察权的职权配置

我国的检察权配置受到分权制衡理论、列宁的法律监督理论以及我国检警相对分离的影响,形成了具有中国特色的检察权配置现状。现阶段我国的检察权配置存在检察权的行政性比较明显、检察权的法律监督权的定位是否准确等一系列问题。检察权的未来改革应当对检察权进行去行政化,并且应当削弱检察权的法律监督权的属性,将监督权的权能回归人民代表大会,净化检察权的司法权性质。
