摘要
2012年新修《民事诉讼法》规定的"实现担保物权案件"与《物权法》相关规定实现了对接,初步建立了我国的抵押权非诉实现制度。该制度所追求的经济、高效,以及其与抵押权内含的变价权、抵押登记的公示公信效力、民事诉讼证明标准的契合,构成了其现实和理论依据。要实现该制度的有效运行,需要在案件受理范围、操作程序以及当事人权利义务的平衡等问题上作出细化规定。
Realizing the security interest case in the revised "Civil Procedure Law" in 2012 connects with the relevant regulations of "Property Law", which means the establishment of the system of hypothec achieved by non-litigation. The economic and efficient value of this system is agree with the right of variable valence in hypothec, the demonstrative effect of the registration system of mortgage registration and the civil procedural proof standard. These systems provide a theoretical basis to realize the hypothec. To make sure the effective operation of the system, some detailed regulations need to be made, such as the scope of accepting the litigation cases, the operation procedure and balancing the relationship between the rights and obligations.
