投资者保护法制框架的境外经验及借鉴——以金融消费者保护为视角

The Overseas Experience of Investor Protection Legal Framework from the Perspective of Financial Consumer Protection

加强对金融领域弱势消费者和投资者保护是应对金融危机的重要经验总结,也是境外最新金融监管体制改革的重点内容。世界银行等国际组织在长期总结梳理和评估测试的基础上提出了证券市场投资者保护的内容框架和良好经验。典型散户市场的结构决定我国证券市场尤其要注重投资者保护,本文对照境外良好经验对我国证券市场投资者保护工作进行了比较和评估,并提出了完善投资保护机制建设等若干建议。

Intensifying protection of vulnerable consumers and investors in financial field is an important experience summary after financial crisis, and it is also an important content of the latest overseas financial supervision system reform. International institutions, such as World Bank, propose the content frame and experience of investor protection of securities market investment. The typical retail investor market structure determines that our securities market should particularly pay attention to investor protection. Compared with overseas experience, this paper evaluates China＇s investor protection, and proposes suggestions on perfecting investment protection mechanism construction.
