摘要
伴随着数字化技术的不断发展,电子商务成为一种新兴的商业模式。后悔权制度是现代消费领域的一项基本制度,而我国法律体系中尚未有真正意义上的后悔权。从电子商务中的后悔权的理论界定讨论,在中国当前后悔权的确立是有其必要性的。我国建立后悔权制度在立法模式的选择与立法内容设计上应当参照其他国家的案例,依据我国现实状况,消费者维权的条文可以表述为:"消费者对网络、电视、电话、邮购等非固定场所销售的商品有权自收到商品之日起七日内以书面形式告知经营者退货,经营者应当自收到退回货物之日起七日内返还消费者支付的价款。"
With the development of digital technology , e-commerce has become a new mode of business .Re-gret right is a basic system of modern consumption , and in the legal system of China there is no regret right system . From the discussion of the theoretical definition of regret right in e-commerce , the establishment of regret right in China ’ s legal system is necessary .To build up this system , the choice of legislation mode and content design should be referring to the cases of other countries .And the provisions can be expressed as follows , “Consumers have the right in written form within seven days from the date of receiving the goods to inform the operator returns the date on the network, television, telephone, mail order sales of non fixed place of goods , business operators shall return the payment within seven days from the date of the return of good from the consumer .
