我国工会制度的立法问题分析及对策

摘要 工会组织作为协调劳资矛盾冲突的重要机构,应在维护劳动者权益、协调企业内部关系方面发挥重要作用。但是,由于工会立法存在诸多不足,导致工会职能定位不清、维权软弱无力,集体维权机制缺失。工会作用的真正发挥,需要反思现有的法律制度,将建立工会作为企业的强制性义务,简化现有的工会建立程序,重新定位工会的维权职能。确立工会独立的运行机制。 As an institution that coordinates employers and workers,trade union should play an important role in protecting the rights and interests of workers and coordinating business-internal relationships.However,the legislative defects regarding trade union have led to some adverse consequences,such as its vague functional placement,weak protection of rights and lack of a collective rights protection mechanism.Current laws should be reconsidered in order for trade union to function effectively.For this purpose,laws should be laid down to oblige a business to establish trade union,current procedures for trade union establishment should be simplified,the rights-protecting function of trade union should be redefined,and the operating mechanism of trade union should be set up.
