Functions and Technology of Serial Numbers of Law

法条序号,是立法者基于特定立法目的以及法条内容的逻辑关系,对法律文本中各个条文先后顺序所做安排的数字符号。法条序号属于"法律数学"的范畴,它是立法者理性的直接体现,是立法者运用逻辑形式,把握、界定法律调整对象,选择法律调整方法,实现立法目的之技术手段。法条序号是法制系统中一项"多功能的立法工具",它至少具有以下七方面的功能:(1)构成;(2)整合;(3)表征;(4)计量;(5)查寻;(6)引用;(7)修改。为了充分发挥法条序号的功能,其设置必须符合特定的技术要求。对于法条序号,须将其作为法条的构成要件;按照特定的逻辑顺序,从第一条连续排列到最后一条;一个法条应具有相对确定的规范容量和文字数;应与法条正文有着严格的对应关系,其表述方法应前后一致,并使用醒目的黑体字;法条序号的表述应由中文数字改为阿拉伯数字;修改后法律文本中法条序号的排列方法应基本不变。

A serial number of law is a digital symbol used by legislators to arrange pro visions in a legal text based on specific legislative purpose and the logical relationship between the contents of different provisions in the legal text. Belonging to the category of ＂the mathemat ics of law＂, it is the direct embodiment of the rationality of legislators and the logical technique employed by legislators to grasp and define objects of legal regulation, select means of legal reg ulation, and realize legislative purpose. As a ＂multifunction legislative tool＂ of the legal sys tem, it has the following seven functions ： （ 1 ） constitution ; （2） integration ; （3） characteriza tion ; （4） measurement ; （5） search ; （6） reference ; and （7） modification. In order to give full play to these functions, arrangement of serial numbers of law must meet certain technical re quirements. Serial numbers of law must be treated as constituent elements of law and be ar ranged in accordance with a specific logical sequence from the first to the last one. A serial number in a law should have relatively fixed norm capacity and number of words and should have a strict relationship of correspondence with the text of the provision. The presentation of serial numbers should be consistent and boldface type and Arabic, rather than Chinese, numer als should be used for them. No major change should be made to the method of arrangement of serial numbers in the revision of law.
