摘要
执法范式融入了执法对司法审查活动的认识与回应。司法面对执法范式时,执法偏好与司法偏好相互叠加生成应和型司法。应和型司法简化了审判要素,弱化了监督制约功能,同时变动了风险成本负担结构,固化了以满意为原则的办案模式,扭曲了社会信息传导结构,一定程度上使司法丧失了对社会的引导功能。要解决应和型司法带来的负面问题,一方面要削减执法范式的外部效应,另一方面要构建与执法相界分的司法审查模式。
Administrative paradigm involves understanding of administration and response to the administrative judgement.When judiciary faces administrative paradigm,echoed judiciary is raised from the preference between the administration and judiciary.Echoed judiciary simplifies elements of the trial,and weakens the ability of supervising itself.Echoed judiciary is likely to change the structure of risk burden,rigidifies mode of handling cases which were decided by the preference of the judge,exchanges the structure of transmitting information and restrain the mechanism of social guidance.In order to solve the negative problems,we should cut the external effects of the administrative paradigm,and construct administrative judgement mode separated from administration.
