土地权利生态化制度补强研究

Reinforcing Research on Ecological Institution of Land Rights

土地权利生态化是生态时代土地权利发展的必然趋势。我国主要经由土地权利外部限制立法路径,已初步建立了土地权利生态化制度。但现有的土地生态化立法成果尚不能满足生态时代土地权利生态化的目标。权利内部限制与土地权利生态化的内在需求契合,可在已有立法成果的基础上,借由"所有权负有义务"之理论工具,将所有权所负义务向生态延伸,拓展所负义务的性质;针对土地权利生态环境保护积极义务制度构造缺失,构建以土地权利人生态环境保护积极义务为中心的制度体系,弥补生态时代土地权利生态化制度构造之不足。

The ecologicalization of land rights is the inevitable development trend of land rights in the ecological era.Legislation of Chinese land rights has initially established ecological system by the right external constraints mainly.But the achievements of existing legislation did not realize theaim of land rights in the ecological era.When the right external constraints coincide with ecologicalization demand of land rights,based on existing legislative achievement,we could expand the obligations of ownership to ecology,develop the nature of obligations by'ownership of the obligations'.We are to establish ecological environment protection system around active duty,strengthen ecological system of land rights to make up for the lack of land right ecological system in the ecological era.
