On the Construction of the Young Family Court——Thinking in a Chinese Path

在我国现有的国情下,无论是构建独立的少年法院还是家事法院都存在诸多无法克服的障碍。家事案件和少年案件趋同的审判理念和程序运作以及我国传统审判方式与二者在制度上的契合,让二者的整合成为了可能。借鉴他国成熟经验,构建适合我国国情的少年家事法庭是破解我国少年审判和家事审判发展困境的有效举措。

Subject to the scope of the problem,the development of the juvenile court in China of has al-ways hovered in the survival and destruction for the past thirty years.The integration of the two is possible since family trial and juvenile justice have convergence in idea and system.Referring to foreign mature experience,constructing the young family court is the best way to walk out of development plight of juven-ile court in China in the present conditions.
