摘要
哈特的法律与道德的关系理论集中体现在他的《法律的概念》一书中,他认为新分析实证法学之所以坚持自然法的最低限度,主要是由于人的自然属性和社会属性决定的。但是由于社会的发展,认识能力的提高,人的社会属性成为人的首要属性,因此法律与道德的关系主要还是分离的。并通过分析、比较、演绎的方法,阐述为什么坚持分离的理由。
the relationship theory of Hart＇s law and morality embodied in his ＂The Concept of Law＂, a book in which he believes the reason why the new law insists on empirical analysis of the minimum natural law, mainly due to the natural and social properties decisions.
