论国际投资条约价值多元化之发展趋势

The Growing Trends of Values Diversification in International Investment Agreements

国际投资条约传统上仅以促进投资自由化和投资者利益保护为价值取向,晚近随着国际社会的演变,开始逐渐关注对国家利益、社会利益等非投资价值的保护。这一趋势既表现为国际投资条约内容上的发展变化,也在当代国际投资仲裁案例实践中有所体现。国际投资条约价值多元化之发展趋势源于新自由主义的失败、资本流动方向趋于多样化、全球治理议题的兴起等多方面原因。国际投资条约的未来发展,应当是在促进投资自由化的同时,逐步实现投资者利益、国家利益和社会利益三者之间的协调统一。中国应在BIT缔约谈判中转变立场、关注多元价值平衡,同时应注重引导"走出去"企业自觉履行社会责任。

Traditionally, the values that the International Investment Agreements （IIAs） have pursued solely are the liberalization and the interest protection.Recently, with the advent of new changes in international situations,IIAs have come to focus on the protection of other values such as state interests and social interests.Such trends can be recognized in the contents of newly signed IIAs and in the practice of international investment arbitration.Many elements have worked together to result in the trends especially the failure of Neoliberalism,the diversification of the directions of capital flows, and the prosperity of global governance.The future development of IIAs will be gradually realizing the coordination and unity of investors＇ interests,state interests and social interests,as well as the promotion of investment liberalization.
