风险社会下我国食品安全犯罪的立法缺陷与完善

风险社会下,科技与食品的结合、利益追求的激烈化,我国食品安全犯罪在犯罪构成的主观、主体要件上出现了诸多与传统犯罪不一样的特点,食品安全犯罪的归责陷入困境。增设严格责任主义下的"风险犯"和提倡食品安全犯罪团体责任显得十分必要。食品安全犯罪立法体系上犯罪客体划分混乱、法规衔接不协调造成的司法运作困境又要求我国必须明确食品安全犯罪客体标准,整合食品安全犯罪于同一章节,设立危害食品安全罪。合理使刑罚提前介入,适当扩大食品安全犯罪圈,才能真正有效地实现食品安全的保护。
