摘要
本文在John Searle、Geoffrey Leech和Jürgen Habermas理论的基础上,结合法律语言的特点,首先把法律施为动词分为断言类、表达类、判告类、诉答类、指令类、承诺类和协调类,然后通过收集我国大陆地区现行的汉语法律文本,按照国内法和国际法、部门法、实体法和程序法等三个维度进行分类,随机提取样本建立库容约为100万字的语料库,利用CKIP autotag 1.0进行词性标注后,通过语料库检索软件AntConc搜索大陆汉语法律施为动词,从语用视角考察汉语法律施为动词的应用情况。
This paper firstly classifies performative verbs in legal texts into assertives, expressives, declaratives, directives, litigatives, commisives and collaboratives,based on John Searle ＇s,Geoffrey Leech ＇s,and Jürgen Habermas ＇ theories and the general features of legal texts. Then a one-million-character corpus is built with random samples from a collection of current legal texts in China's Mainland, which are classified into 3 groups in line with domestic and international laws,department laws,substantive and adjective laws. After POS tagging with CKIP autotag 1. 0,it retrieves performative verbs with AntConc and explores the applications of Chinese performative verbs in legal texts from the perspective of pragmatics.
