基于京、沪、穗三地近十年来外国人犯罪的整体状态和案发规律,以及世界各国外国人犯罪冲击本国社会秩序、国民心理,乃至成为国家非传统安全的隐患的现实,我国应当充分重视在华外国人违法犯罪活动的现实与潜在威胁。在立法体系相对滞后的背景下,当前防控外国人犯罪的司法实践产生诸多问题,应本着维护本国国家和公民利益原则的基础,兼顾对等原则,构建应对外国人犯罪的法律与实践处置措施。

Based on an analysis of trends in crimes committed by foreigeners of Beijing Shanghai Guangzhou in the past decades, China should give full attention to the reality and potential threat of illegal and criminal activities of foreigners in china. there are many problems in the judicial practice about crimes committed by foreigners. China Should increased the applicability of chinese criminal law, raised awareness of territorial jurisdiction and constructed the measures to deal with the crimes committed by foreigners.
