长白山野生药用植物遗传资源法律保护探微

Legal Protection of Changbai Mountain Wild Medicinal Plants Genetic Resources

长白山因其独特的地理环境,药用植物资源颇为丰富,享有"北方天然药库"的美誉,对我国中医药、食品等产业的发展起到了巨大的推动作用。然而,由于无节制的滥采滥伐,致使大量野生药用植物资源几近枯竭,而人工培植种源混杂,种质退化严重,加强对野生药用植物遗传资源的保护刻不容缓。该文对当前有关保护生物遗传资源的法律框架以及管理机制进行梳理,从立法和执法角度对合理开发和保护长白山区野生药用植物遗传资源进行分析,并提出可行性建议。

Changbai Mountain because of its unique geographical environment, has quite rich resources of medicinal plants, enjoy a good reputation of ＂Northern Natural Drug Storehouse＂, plays a huge role in pro-moting the development of traditional Chinese medicine, food and other industries in China. However, due to the excessive indiscriminate deforestation, resulting in a large number of wild medicinal plants resources almost depleted, and artificially propagated provenance mixed, germplasm serious degrada-tion, so strengthening the protection of wild medicinal plants genetic resource is imperative. In this pa-per, the current legal framework and management mechanisms for the protection of genetic resources are sorted out, the rational development and protection of Changbai Mountain wild medicinal plants genetic resources are analyzed from the perspective of legislation and law enforcement, and put for-wards feasible suggestions.
