独联体成员国《示范互联网调整基准法》的基本内容及对我国互联网管理立法的启示

Main Contents of Model Internet Adjustment Standard Law of Member Countries of CIS and Its Enlightenments on Internet Management Legislation in China

介绍和分析了独联体成员国《示范互联网调整基准法》的基本原则和调整机制。在互联网管理立法中,我国应当对互联网的管理采取适度原则,尊重互联网建立和发展所依据的原则和规律,注重保障公民和法人使用互联网和获取互联网信息的自由;应当明确国家负有鼓励发展和使用互联网基础设施的义务,并承担保障所有使用者平等获得互联网服务的义务。对通过互联网实施的法律行为,应当按照行为实施时主体所在的地点和时间来确定,并采用地域管辖原则(属地管辖原则)。同时,域名登记机关可以涂销违反本国立法或者他国公共秩序的域名,或者由管理员用于从事本国立法所禁止活动的域名。

Through the introduction and analysis to basic principles and adjustment mechanism of CIS Member States＇ Standards Law on Demonstration of Internet Adjustment, legislation on Internet management in China should involve the following ： adhere to the principle of moderation ; respect the rules set during the establishment and development of Inter- net; safeguard the freedom of citizens and legal persons to utilize Interact and obtain information. Besides, the nation should have explicit obligation to promote the development and utilization of Internet infrastructure, as well as to guaran- tee the equal access to Internet services. Legal action conducted through the Internet should be determined according to the time and place of its implementation by the subject, under the principle of Regional Jurisdiction. Meanwhile, Regis- tration Authority of domain name is entitled to override a domain name where it violates any laws in China and abroad or domain names used by administrators for activities prevented by the domestic statutes.
