A Normative Analysis of Technology Standards: Unified in Formal Sources and Substantive Validity of Law

技术标准包含专利权权利客体和制度性事实规范双层含义。技术标准规范是由作为参数、术语等纯粹标准部分和相关涉技术标准的法条结合而成的一种法律规范。其中,参数、术语等符号构成该法律规范的行为模式部分,这在形式上使技术标准规范具有法源的性质和地位。技术标准的实质效力体现在司法裁判和对标准解释的活动中,技术标准规范的实质效力的实现需要发挥行政机关的核心作用,并在此基础上建构一种特殊的解释机制。

Technical standards include double meaning： patent rights norms object and institutional facts.
