摘要
刑事和解的正当性在于实现"心的和解"。"心的和解"包含大量的情感因素,这与理性设计的刑事和解制度存在着内在矛盾。作为回归实质合理性的制度安排,刑事和解制度仍会遭遇理性制度与生活世界的冲突,而使其运作效果具有不确定性。刑事和解制度的司法操作,应着眼于其正当性基础,促成"心的和解",努力消解其不确定因素。
The due value of criminal reconciliation embodies realizing the heart reconciliation. The heart reconciliation involves a lot of emotional elements which inevitably counteract the rational system of reconciliation. As the return to the substantial ration the system of criminal reconciliation still encounters the contradiction between the rational system and life world, which brings uncertain effects. The criminal reconciliation should be operated on the due foundation to promote heart reconciliation and dispel the uncertain elements.
