摘要
《淮南子》对"法"的论述,依违于法家、道家和儒家思想之间,呈现出似法非法、似道非道、似儒非儒的特征。就"法"存在的合理性而言,《淮南子》认同法家的理解,但又从道家理论中寻找更高尚的理论动机,在现实政治中发生儒家式的偏转;就"法"的社会功能而言,《淮南子》同样有对法家的承续,同时又有对道家之"道"的歪曲,并蕴涵有向儒家转换的潜在逻辑。
The discussion of "law" in Huainanzi depends on the thoughts among Legalism, Taoism and Confucianism, thus showing an ambigious characteristics. As for the rationality of the existence of "law", Huainanzi favored the interpretation of legalism. However, it sought more gracious theoretical motivation in Taoist theory and carried out Confucian deflection in realistic politics. As for the social function of the "law", Huainanzi has inherited legalism, violated Taoism and potentially transformed into Confucianism.
