中国足球协会内部纠纷解决机制的完善——以体育自治为基础的考量

On Improvement of the Internal Dispute Resolution Mechanism of Chinese Football Association:A Consideration Based on Sports Self-governance

体育自治是足球协会乃至所有体育组织内部纠纷解决机制的基础。以体育自治为基础,审视我国足球协会内部纠纷解决机制的完善,在理论上具有重要意义。随着2009年《中国足球协会仲裁委员会工作规则》的颁行,中国足协内部纠纷解决机制较之于以往得到了较大改进,但在具体制度设计上仍有需要完善之处。总结、比较国际足联及其他国家足球协会内部纠纷解决机制的既有经验,有助于完善我国足协现有纠纷解决机制。建议在我国足协增设上诉委员会;明确仲裁委员会及上诉委员会的人员组成并增设足协内部纠纷解决的监督机制。

Sports Self-governance is the fundamental origin for the establishment of internal dispute resolution mechanism of football associations and all the sporting associations as well. So it is quite meaningful to investigate the improvement of the internal dispute resolution mechanism on the basis of self-governance. With the enactment of The Working Rules of Arbitration Committee of Chinese Football Association in 2009, many amendments have been made to the previous internal dispute resolution mechanism, but there are still some defects that needs to be further perfected. Through comparing the similar institutions of FIFA and other countries, this article offers some suggestions for the improvement of the mechanism as follows： setting up the appeal committee; ascertaining the compostion of the appeal committee and the arbitration committee; establishing the corresponding supervisory mechanism.
