摘要
纪委和检察机关作为我国反腐败的两大支柱,在反腐败工作中面临协作机制不畅通、协作规定不健全的问题,检察机关和纪委在反腐败协作中,应该在各自独立自主、恪守法律基础上,探索建立协作工作领导小组、重点关注大要案的相互协助问题,以期在协作中互相之间形成监督,从而建立起高效有力的相互协作制度。纪委和检察机关在反腐败工作中的协作问题,是一个实践性很强的问题。由于纪委在党内政治地位高于检察机关,检察机关的法律监督职能往往不能完全落实。检察机关在反腐败过程中,必须处理好和纪委的关系,以达到法律和政治的平衡。同时,纪委的反腐败活动也在逐渐规范化、法律化,从长远来看,纪委和检察机关的反腐败协作必然是一个法治化的进程。
Disciplinarum committee and procuratorial organ are the two backbones in anti-corruption activities in our country. But the two organizations face the issues of stuffed coordinate mechanism and lack of regulation. In anti-corruption coordination, it is important to establish a coordinate leader team based on law and separate status, paying attention to important cases in order to improving mutual monitoring and coordination. Because the status of disciplinarum committee is superior to procuratorial organ, the monitoring function of procuratorial organ can not be achieved. In anti-corruption process, it is necessary to balance the relationship between law and politics with the coordinate relationship between procuratorial organ and disciplinarum committee. In the meanwhile, the anti-corruption activities of disciplinarum committee should be normalization and legalization. In the long run, the coordinate mechanism of disciplinarum committee and procuratorial organ in anti-corruption activities must comply with the rule of law.
