个人权利与生命价值——以健康权为例

Individual rights and the value of life- A case study of the right to health

自从权利概念在现代出现以后,个人权利就在个人生命价值的实现中占据重要地位,比如健康权。健康权作为个人权利首先是人的道德权利,然后被法律所承认和创造而成为法律权利,前者是其得以成立的根据,后者则是其得以实施的条件,因而在个人生命价值的实现过程中具有至关重要性。

Since the concept of the right appeared in the modern, individual rights have occupied an important position in the realization of personal value of life, such as the right to health. The right to health as an individual right is moral right of people at first, and then admitted by the law and created into the legal right. The former is the basis to be established, and the latter is the condition to be implemented, and thus is of crucial importance in the implementation process of the value of life.
