神判法的前世今生——读《中国法律与中国社会》有感

《中国法律与中国社会》既是一本法律史书,亦是一本社会史书。它清晰而明确地论证了法与社会有着密不可分的依存关系。法不只反映了当时的社会制度、道德、伦理和信仰等价值观念,也调整和维护了一定时期的社会结构。《中国法律与社会》一书第五章第一节的主题为"神判"。瞿同祖先生引经据典,依据大量个案和判例,以法社会学的研究方法分析了中国古代法律中的神判在社会上的实施情况及其对人民生活的影响,揭示了中国古代的神判与法律功能的密切联系。

＂Chinese Law and Chinese Society＂ is both a legal history book and a social history book. It has clearly demonstrated that there are inextricably interdependent relationship between the law and the society. Law is more than reflected the prevailing social system, values, morals and ethics, but also to adjust and maintain the social fabric of a certain period. The theme of the first section in the fifth chapter of the book is ＂Ordeal＂. Mr. Qu Tongzu quoted a large number of cases to analyze the implementation of ancient Chinese judgment in the community and its impact on people＇s lives by the methods of sociology of law, revealing the close contact between the ancient Chinese Ordeal and legal functions.
