善意取得制度是物权法的重要组成部分 ,来源于日尔曼法的“以手护手”原则 ,是对物权追及力的限制 ,目的是为了保护交易安全。确立善意取得 ,要求主体、客体及内容必须符合法律规定的条件。

Goodwill gain system,the important part of the Real Right Law,originates from the principle of “Hand in Hand” in Germanic Law and restricts the ascending power of real right.Its aim is to protect the safety of exchange.To establish goodwill gain,its subject and object and content should conform to the condition provided for by law.It produces the legal effect of both real right and creditor's right relations.
