摘要
在不同的法域中,由于对违法所得没收程序的性质存在认识差异,导致违法所得没收申请人的模式存有单一式和多元式两种。我国刑诉法将人民检察院确立为违法所得没收程序的申请人,此立法规定在功能和效率上无疑都契合了当下的制度语境。但从长远的观点看,人民检察院担任违法所得没收的申请人存在法理上的悖论。因此,确立资产权属机关为主,检察院为辅的申请人制度应是今后制度改革的方向。
In different jurisdictions, due to understanding differences about the nature of the illegal income confiscated program, there will be two kinds of models such as single and multiple which leads to the illegal income confiscated applicant. The criminal procedure law in our country establishes people's procuratorate as unlawful income confiscated program applicants, fitting the current institutional context on the function and efficiency. But from a long-term point of view, that the people's procuratorate served as the illegal income confiscated applicant exists paradox of jurisprudence. Therefore, the applicant system of which asset owner-ship is given priority to procuratorate should be the direction of the reform of the system in the future.
