Study on Balance between University Autonomy Rights and College Students' Rights

现代社会大学生起诉高校的案件越来越多,诉讼结果各不相同,学生受教育权难以救济。对于该问题我们必须溯本逐源,从高校自治视角来研究大学生权利救济才能从根本上解决一系列理论问题,进而推动立法和司法实践工作顺利进行。

T here are more and more cases that college students sued universities and the litigation re-sults are different ,too .T his paper talks about the difficulty remedy of the education right to these college students .And therefore it studies the university autonomy which can fundamentally solve the problems of education right remedy .The paper also suggests that the university autonomy can also help legislative and judicial practice more smoothly .
