城中村改造与中国土地制度改革:珠三角的突破与局限 被引量:43

摘要 中国未来土地制度改革的一个核心突破口就在城乡结合部的城中村与城郊村地段。城中村、城郊村改造首先要处理好被更新地段土地权利配置问题:以土地国有化为前提,原土地权利人村集体和村民上缴一部分公益事业用地和基础设施融资用地后,对剩余部分土地使用权确权并进行开发,实现公有私用,最终建立政府、原土地权利人、外来人口,乃至开发商多方的利益均衡。中国未来的城中村、城郊村改造实践要处理好所有权人过多导致的钉子户问题和多重政府管制导致的规划建设审批成本过高问题,并全面借鉴国际经验和本土实践,突破既有改造模式的局限,全面有效地处理好小产权房问题,实现中国土地制度改革的突破与新型城镇化转型。 A key breakthrough in China's future land system reform lies in the redevelopment of the villages in the cities and fringe areas.We propose an innovative reform in urban renewal and urban village redevelopment.To begin with,the local governments can be authorized to take some of the rural collective land for free to develop and finance urban village infrastructure redevelopment.The development rights for the remaining land would be granted to the original land owners,i.e.,the village collective and the villagers.This model of urban village redevelopment is more socially beneficial and economically sustainable and will finally lead to an equitable distribution of land value appreciation among the original land owners,migrants,local governments and real estate developers.Then China must properly deal with the issue of anti-commons caused by too many owners and reduce the cost of excessive government regulations.It should also learn from the experiences of other countries and its own local practices to make a breakthrough in its land development regulation.It should cast away the existing mode of redevelopment and effectively clear the issue of 'houses with limited property rights' to make a breakthrough in its land system reform and promote a new-type urbanization.
