论“国家治理体系和治理能力现代化”的“法治精神”

推进"国家治理体系和治理能力现代化"是对与工业、农业、国防和科学技术"四个现代化"相对应的国家软实力"现代化"提出的要求。文本指出,"法治精神"是对"国家治理体系和治理能力现代化"的核心要求,"现代化"的国家治理体系既需要完善静态的法律体系,也需要建立健全动态化的法治体系,国家治理体系的现代化要求建立符合法治原则的规则体系、公共权力配置体系、公民的基本权利体系和基本义务体系、国家责任体系和政府责任体系以及公民的"普遍责任体系"。"现代化"的国家治理能力实际上要求国家治理活动中能够有效地运用"法治思维和法治方式"来解决国家生存和发展中出现的重大而复杂的社会问题和治理事务。
