如何健全食品安全监管法律体系

摘要 近年来食品安全事件屡屡发生,其主要原因就在于其法律体系落后。对此如何健全呢?可从两方面着手:一是健全法制内容。增加全程监管、食品安全新标准,加大惩罚力度,实行法律问责制、食品召回制,确立风险检测立法,强化食品代言法律责任等;二是在法律法规制定的程序方法上,重视前瞻性规划的制定、公众参与立法及综合立法等。以此建立科学协调配套的法律体系,必将有力推动食品问题治理与社会转型进程。 In recent years, food safety occurred frequently, the main reason lies in its lagging legal system. How to improve this situation? There are two-pronged approach: First, improve the legal content, increase the whole regulation of new food safety standards, increase the punishment degree, carry on legal accountability and food recall system, establish risk detection legislation, fortify foods endorsement legal liability and so on; Second, in the procedural methods laws enacted, pay attention to the determination of forward planning, public participation legislation and comprehensive legislation. Establishing scientific, coordinated and complete legal system will greatly promote the food problems governance and social transformation processes.
