模拟法庭教学方案研究与探索

Research and Exploration in Teaching Plan of Moot Court Education

为解决目前模拟法庭教学中脱离实践和效果不理想的问题,采用了质的研究和实验验证的方法,提出了模拟法庭教学方案的改进建议。在考察了目前模拟法庭教学当中出现的主要问题,包括教学制度安排、案例选择改变、学生角色定位、庭审设置和评分机制上的问题;并针对问题设计模拟诉讼规则。通过组织比赛的方式,验证模拟法庭教学方案的探索思路,从而提出了五项改进建议:①确立课堂规则,发布指导手册;②建立案例库;③缩减课堂容量,建立竞赛机制;④建立法官主导庭审模式;⑤利用规则微调实现学生不同能力的锻炼。通过实验总结出的结果,改进了模拟诉讼规则,将其应用到教学当中,取得了较为理想的效果。

In order to solve the problems occurred in moot court education such as the disjoint between theory and practice and lacking effectiveness.This paper discusses suggestions of improvement for moot court teaching plan through approaches of experimental verification and qualitative research.This paper mainly studies the major problems arose in various aspects in the current moot court education,including teaching system arrangement,case selecting,role definition,setting of trail and evaluation mechanism.Aiming at these problems,this paper designs several regulations for the moot court.This paper validates the exploring ideas for moot court teaching plan by organizing competitions,and proposes five suggestions of improvement：（1） Establishing class rules and guide books;（2） Establishing case data base;（3） Reducing class size and establishing competition mechanism;（4） Establishing authority principle pattern;（5） Cultivating students with different capabilities.This paper improves the regulations of moot court by implementing the results of examination These measures successfully achieved ideal outcomes after applying them to teaching.
