版权技术措施虽然是保护版权的私力手段,但其本身也需要法律的保护,无论是从版权技术措施作用机制、遏制版权技术措施规避行为角度,还是从履行国际义务的方面来看,对版权技术措施既需要民法保护,更需要刑法保护。

As a private means of protecting copyright, the technical measures of copyright needs legal protection itself. Whether to its function mechanism and the containment avoidance, or to the fulfillment of international obligations, it may need the protection of civil law as well as criminal law.
