试论审理行政许可诉讼的若干问题

在审判实践中 ,经常出现争议的问题有 :行政许可诉讼的原告主体资格界定 ,行政许可行为的司法审查程度 ,行政许可权利人同与行政许可行为有法律上利害关系人之间纠纷的性质、处理原则以及行政许可诉讼所涉及的行政侵权赔偿。

In judicial practice, the controversies concerning the following issues often take place:defining plaintiff's subject quality in administrative license actions;the degree of judicial investigation on administrative license act;the characteristic and principle of sanction as to the disputes between the obligees in administrative license actions and the legally interested persons in administrative license acts; compensation and recuperation for government tort regarding administrative license actions.
