中国海外投资的立法体制不合理和立法原则不明确直接阻碍了海外投资实践及其立法的进一步发展。因此 ,确立海外投资立法的四项基本原则 :有利于本国经济发展原则 ,全球经营一体化原则 ,国家经济安全原则以及长期规划与短期计划相结合原则 ,完善海外投资的立法体制 ,对于指导和促进海外投资的立法和实践具有重要的现实意义和理论价值。

It is the unreasonable,vague-cut legislation system and principle of Chinese overseas investment that directly hinder the development of its legislation and practising.For promoting and guiding the legislation,it's very important both theoretically and realistically to establish.the four basic principles and to perfect the legislation system,which includes:being beneficial to Chinese economic development,carring out the global management strateges,protecting the state economic safety and combining the long-term programme with the short-term plan.
