检察解释论析

Comment on Procuratorate's Interpretation

揭示检察解释与检察权的关系，认为检察解释是检察机关行使职权的方式，因此检察解释的主体是全体检察机关而不仅仅是最高人民检察院；由于检察权的性质不是司法权而是一种程序性的权力（法律监督权），因此，检察机关对实体法的解释也只具有程序性的效力。

This article indicates the relationship of procutatorate' s interpretation and the power of procuratorate. The writer considers that procuratorate's interpretation is one way to perform its official powers. thus it is the whole procuratorate system not only the supreme procuratorate be the subject of the procuratorate's interpretation. Because the nature of procuratorate ' s power is not judicial power but a procedure power(legal supervisory power),the interpretation of subjective law of procurator office only has procedural effect.
