摘要
新型城镇化进程中应保障农民的土地权益,对农村集体建设用地使用权流转制度进行改革和创新,其基本路径是引入市场化运作机制,允许农村集体建设用地使用权以多种方式直接对外流转。而地方政府应加强对农村集体建设用地使用权流转的监管,确保农村集体建设用地使用权流转符合城乡建设规划、土地利用总体规划和年度计划,以及耕地保护、土地用途管制制度的要求,并为农村集体建设用地使用权流转提供支持和服务。
the farmers rights on rural land should be protected in the process of new type towns construction, the basic route ot renovating the system of rural collective-owned construction land transferring is adopt market acting system, and permit the exchange of rural collective-owned construction land by types mode. The local governments should enforce supervision in order to ensure the exchange according with the plan of construction, the whole plan and yearly plan of land-using, as well as the require of rural land protecting and land-using control. Moreover, the local governments should provide necessary supports and service to the exchange of rural collective-owned construction land.
