新型城镇化进程中应保障农民的土地权益,对农村集体建设用地使用权流转制度进行改革和创新,其基本路径是引入市场化运作机制,允许农村集体建设用地使用权以多种方式直接对外流转。而地方政府应加强对农村集体建设用地使用权流转的监管,确保农村集体建设用地使用权流转符合城乡建设规划、土地利用总体规划和年度计划,以及耕地保护、土地用途管制制度的要求,并为农村集体建设用地使用权流转提供支持和服务。
