摘要
罪犯作为人类成员、社会成员和国家成员而享有劳动报酬权既有其正当性又有其特殊性,推行罪犯劳动报酬制度提高了罪犯的劳动积极性,有利于罪犯人权保护,有利于服刑人员的再社会化;借鉴国外罪犯劳动报酬制度的成功经验,结合我国国情,对我国罪犯劳动报酬的范围、标准、考核条件、支配、发放和管理、监督等方面提出具体建议。
As the human members, members of society and country members, Criminals enjoying the labor remuneration right has its legitimacy and its particularity. Implementing criminals labor remuneration system can improve the criminals labor enthusiasm, which is propitious to the criminal human rights protection and the resocialization of prisoners. This paper makes specific recommendations on the ranges, the examination conditions, standard, control, management, distribution, and supervision of our country's criminals labor remuneration on the grounds of borrowing lessons from the successful experience of foreign criminals labor remuneration system and our own national condition.
