摘要
由于外派员工制度的结构较为复杂,涉及到多方主体利益,基于多个合同关系才能实施,因此,在员工和企业(单位)、企业(单位)与企业(单位)之间的纠纷屡见不鲜,责任主体往往难以确定,责任承担方式无法落实。完善外派员工制度需要从多重合同关系入手,解决外派员工纠纷问题要从单个合同关系入手,确定具体的合同性质,选择恰当的法律规范。
The structure of dispatched employees is very complicated,which is related to multiple parties and based on different contracts relatinships.So,the disputes between employees and enterprises are common,and it is difficult to determine the subjects of responsibility and methods of undertaking responsibility.The perfection of this system must strat from the multiple contracts relationship,while the dispatched employees' disputes could be settled by starting with a certin contractual relationship,determining the character of the contract and selecting the appropriate legalnorms.
