摘要
权利义务的合理范围也就是法学意义上的限度主要解决的问题,通过在权利、权力、义务之间设定必要的界限以规范其相互之间的制约和被制约、平衡和被平衡关系,权利义务的限度实际就是对权利义务的设立和运行范围的合理限定。
The rational range of rights and obligations is a major problem in the study of “limitation” in law. By setting necessary limitations among rights, powers and obligations, their relationships of restricting and being restricted, balancing or being balanced are specified, so the limitations on rights and obligations is actually setting rational limitations on the establishment of rights and obligations as well as the operating range.
