论信息化侦查法律规制的原则

On Principles of the Legal Regulation on Information-based Investigation

信息化侦查是区别于传统侦查模式的一种现代案件侦查方法,在侦查过程中利用技术手段能获取诸多的信息。在信息的获取和使用过程中则可能存在着对私权利侵犯的可能。我国目前对信息化侦查进行规制的法律法规不多,对信息化侦查的规制更多的是依靠侦查机关自身的自觉,而对其进行合理的规制有明显的积极意义。在对信息化侦查中信息的获取途径的研究前提下,提出了信息化侦查法律规制中应该坚持的三项基本原则,即:价值理性与工具理性相统一的原则;内部控制与外部监督相统一的原则;法律控制与技术规制相统一的原则。

The information-based investigation, as a modern method differs from the traditional ease investigation mode, has access to more information with the aid of technological means in the investigation process, but is likely to infringe the private rights in process of getting and using information. Currently, making reasonable regulations has a positive significance because the laws and regulations on information-based investigation are insuffieient and the investigation organs rely more on intuition. On the premise of studying the approaches of getting information in the infiu＇mation-based investigation, the thesis puts forward that we should adhere to the three basic principles： the unity of valne rationality and instrnmental rationality, the unity of internal control and external supervision, anti the unity of legal control and teehnieal regulation.
